Telematics have often been viewed by some organisations as an intrusive ‘spy in the passenger seat’. However, with police tightening up on corporate manslaughter prosecutions, fleet decision makers are becoming more aware of their increasing importance in helping them to comply with the law and guard against prosecution.
The HSE (Health and Safety Executive) sets out guidance on The Corporate Manslaughter and Corporate Homicide Act 2007 landmark in law. For the first time, companies and organisations can be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of a duty of care. The Act, which came into force on 6 April 2008, clarifies the criminal liabilities of companies including large organisations where serious failures in the management of health and safety result in a fatality.
Although the new offence is not part of health and safety law, In recent years, Fleet operators have been warned that police forces across the UK are waiting to convict one of them under corporate manslaughter and corporate homicide legislation.
